  P.R.China-Mongolia Extradition Treaty

As an increasing number of Southern (Inner) Mongolian exiles including some asylum seekers in the independent country of Mongolia are extradited back to China, the Southern Mongolian Human Rights Information Center (SMHRIC) obtained the Chinese and English versions of the "Treaty on Extradition between Mongolia and the People's Republic of China" that presumably serves as the legal basis for recent extraditions carried out between Mongolia and China. Certain articles of the treaty suggest that the Mongolian authorities could have had the sufficient legal basis to reject the Chinese authorities' requests for extraditing some Southern Mongolian exiles including Mr.Dalaibaatar Dovchin and Mr.Tulguur Norovrinchen. Such articles include the Item (3) of "Article 3: Mandatory Grounds for Refusal" that states: "Extradition shall not be granted in any of the following circumstances: ....(3) The requested Party has substantial grounds to believe that the request for extradition has been made for the purpose of prosecuting or punishing the person sought on account of that person's race, religion, nationality, sex or political opinions, or that person's position in judicial proceedings maybe prejudiced for any of above-mentioned reasons."
